2. Sponsor: The sponsor of this Sweepstakes is A $49.95 Any Sewer or Drain, Inc, located at P.O Box 40 Bethpage NY 11714(”Sponsor”).

3. Eligibility: A $49.95 Any Sewer or Drain, Inc Sweepstakes (the “Sweepstakes”) is offered to legal residents of the 50 United States or the District of Columbia who at the time of entry are 18 years of age or older and have pre-existing internet access. Employees and agents of Sponsor and/or its affiliates, agencies and distributors (”Associated Persons”), members of such Associated Persons’ families, and individuals living in the same household with such Associated Persons are not eligible to win. Void in Puerto Rico, outside the United States, and where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations.

4. How to Enter: The Sweepstakes begins at 10:00 AM Eastern Daylight Time (”EDT”) on July 15, 2009 and ends when the sponsor decides to end.. To enter, visit http://www.a4995.com/sewer_problems/ and write about an incident where you or someone you knew faced a sewer or other plumbing problem. Limit one (1) entry per person/ per valid email address/ per entry period (described below in Section 5). Entries are the property of Sponsor and will not be acknowledged or returned.

5. Prize Drawing and Entry Periods: Prize winners will be selected in random drawing every month from among all eligible entries received by the Sponsor during entry periods.

Sponsor’s decisions will be final in all matters relating to the Sweepstakes and winner eligibility. The potential winners will be notified by email and/or certified mail. The potential winners will be required to sign and notarize an affidavit of eligibility which affirms that he/she is eligible and has complied with these rules, as well as a liability release, and where legal, a publicity release. Guests may also be required to execute liability/publicity releases. The potential winners must respond within fourteen (14) days from the date of notification by Sponsor or the prize will be forfeited and awarded to an alternate winner by random drawing from remaining entries. If any prize notification is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner by random drawing from selected entries. Eligibility, age, and claims made by prize winners are subject to verification. Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to the use of his/her name, testimonial, photograph, or other likeness, and/or prize information, without further compensation or notice to, or further consent of, the winner for advertizing, promotional, and publicity purposes in any media now or hereafter known throughout the world, in perpetuity, by Sponsor to the extent permitted by law.

6. Odds: There will be a total of one (1) winner every month. Odds of winning any random drawing will depend on the number of entries received during the applicable entry period(s).

7. Prizes and Approximate Retail Values: There will be one (1) Prize. The prize for every month will be different and will vary from cash priz to electronics.

The prize winners will be issued an IRS Form 1099 for the ARV of the prize awarded. Sponsor has the right but no obligation to substitute a different prize of equal or greater value.

8. General: By entering, entrants agree to release and hold harmless Sponsor and each of its parents, subsidiaries, divisions, representatives, affiliates, advertising and promotional agencies, wholesalers, retailers, partners, suppliers, any company presenting any part of the prize, and each of the foregoing entities’ employees, officers, directors, owners, agents, successors and assigns (collectively the “Released Parties”), from and against any and all costs, expenses, claims, demands, proceedings, suits, actions and/or liabilities for any injuries, death, loss or damage of any kind arising from or in connection with accidents, terrorism, theft, natural disaster, the promotion of the Sweepstakes, the distribution of any prize, entrants’ participation in and/or entry into the Sweepstakes, acceptance or use of any prize by any entrant or Guest or unavailability of any prize. PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND FROM SPONSOR.

The Sweepstakes shall be governed by, and construed in accordance with the laws of the state of New York. All federal, state and local laws and regulations apply. All entrants agree that the Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Sponsor due to technical problems, human error or traffic congestion on the internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the Sweepstakes, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, incomplete and/or unintelligible (or any combination thereof).

Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, abbreviate or suspend the Sweepstakes or any portion thereof for any reason without further obligation or advance notice. If the Sweepstakes is not capable of running as planned by Sponsor, notice will be posted on www.a4995.com. In the event that the Sweepstakes is abbreviated for any reason, the Sponsor reserves the right at its sole discretion, but is under no obligation, to award prizes from among all valid and eligible entries received up to the time of termination.

By entering, entrants agree to comply with these rules. Any entrant who attempts to tamper with the Sweepstakes, in Sponsor’s sole discretion, shall be disqualified. In the event of a dispute as to who submitted an entry, the Entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” means the natural person assigned to an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES TO THE EXTENT ALLOWED BY LAW) FROM ANY SUCH ENTRANTS TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

If any portion of these rules is determined to be invalid or illegal, the remaining portions of these rules will remain in effect and be construed with their terms as if the invalid or illegal provision were not contained herein.
